When it comes to compliance with labour law postings, there are several legal posters summarizing pieces of legislation that are available but, your workplace may not need all of them. So how do you determine which labour posters you need to display?

Which 3 Labour Posters must be displayed?

Some of the legislation and regulations enforced by the South African Department of Labour require that labour posters be provided to employees and/or posted in the workplace. Employers can gain access to this legislation from the state and department websites, or they may choose to order them in large poster format from a poster vendor, such as the Estome Publications Store.

It should be noted that the requirements vary by law or regulations; that is, not all employers are covered by each of the Department’s legislation and thus may not be required to post a specific labour poster / notice. For example, you are only required to post Schedule C of the General Machinery Regulations, OHS Act 1988, where you have boilers on your premises.

The Compulsory Posters:

Employers are required to display two (2) labour posters (Act Summaries) in a prescribed format, as follows:

Occupational Health and Safety Act Requirements:

The Occupational Health and Safety Act (Act 85 of 1993) and Regulations are required for employers with five (5) or more persons in their employ. This refers to the full Occupational Health and Safety Act (OHS Act) and the relevant regulations, however, it does not hurt to have this in poster format as well. If the total number of employees is less than five, the employer must, on the request of an employee, make a copy of the Act available to that employee.

Size and Display Requirements:

Employers are required to have labour posters conspicuously posted at each organizational facility. Required posters must be displayed so they are easily visible to the intended audience, according to the DOL. A reputable supplier usually carries these in A1 (594 x 841mm) or A2 (420 x 594 mm) poster size.

These labour posters must be displayed conspicuously in an area that is regularly visited by employees. This could be on designated bulletin boards, in an employee lounge, in breakrooms and kitchens, in a passageway that all employees use, or in locker rooms.

Employers who don’t comply with the above-mentioned prescriptions may receive penalties from the Department of Labour.
