Description
The Basic Conditions of Employment Act, No 75 of 1997 gives effect to the right to fair labour practices referred to in section 23(1) of the Constitution by establishing and making provision for the regulation of basic conditions of employment; and thereby to comply with the obligations of the Republic as a member state of the International Labour Organisation. The act applies to all employers and workers and regulates leave, working hours, employment contracts, deductions, pay slips, and termination.
The act does not apply to members of the following: National Defence Force, National Intelligence Agency, South African Secret Service; or unpaid volunteers working for charity. The section of the Act that regulates working hours does not apply to: workers in senior management, sales staff who travel and regulate their own working hours, workers who work less than 24 hours in a month, workers who earn more than R205 433.30 per year and workers engaged in emergency work are excluded from certain provisions.
