The Basic Conditions of Employment Act, No 75 of 1997 gives effect to the right to fair labour practices referred to in section 23(1) of the Constitution of RSA, applying to all employers and workers and regulates leave, working hours, employment contracts, deductions, pay slips, and termination.
The Occupational Health and Safety Act (Act 85 of 1993) and the relevant regulations, on the one hand, must be made readily available at a workplace employing 5 or more workers. Even where the total number of employees is less than five, the employer must, on request of an employee, make a copy of the Act available to that employee.
